BYPG, LLC (“we,” “us” or “our”) respects your privacy and is committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide to us through services accessible via our website located at www.bypg.com or any other website, IP address, social media account, web app, or other online product or service offered by us (collectively, the “Service”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect through the Service and in email, text, and other electronic messages between you and the Service. It does not apply to information collected by us offline or through any other means, including on any other website operated by us or any third party or by any third party that may link to or be accessible from or on the Service.

1. Information We Collect

Information We Collect Through Automatic Data Collection Technologies  

As you navigate through and interact with our website, we may use automatic data collection technologies (generally, Google Analytics) to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to the website, such as traffic data, location data, logs, and other communication data, and the resources that you access and use; and
  • Information about the device you are using to access the Service and internet connection, including, but not limited to, your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (e.g., behavioral tracking). 

The information we collect automatically is only statistical data. It helps us to improve the Service and to deliver a better and more personalized products and services, including by enabling us to:

  • Estimate our audience size and usage patterns;
  • Store information about your preferences;
  • Speed up your searches; and
  • Recognize you when you return to our website.

Information You Provide to Us

If you contact us on or through the Service, such as to sign up for a newsletter or other offer, the information we collect may include personal information such as name, e-mail address, telephone number, and any other information you provide to us, including records and copies of your correspondence.

2. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide, support, personalize, develop, and/or improve the effectiveness of the Service, website, stores, mobile experience, and our marketing efforts; 
  • Create, maintain, customize, and secure your account with us; 
  • Send marketing communications and other information regarding products, services and promotions;
  • To help maintain the safety, security, and integrity of the Service, databases, and other technology assets, and our business;
  • Conduct research and analysis;
  • Process your requests, purchases, transactions, and payments and to prevent transactional fraud;
  • Respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; 
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA; and

In addition, we may disclose certain data to advertising platforms, including Google and social networks such as Facebook and LinkedIn to allow us to target existing users and customers with highly relevant advertising campaigns. For the purposes of such campaigns. We may share a unique code (such as a hashed email address) with the applicable advertising platform for that identifier to be matched against existing users of the relevant advertising platform and to identify potentially relevant audiences for targeted advertising. We may use services such as Google Ads’ Customer Match, LinkedIn Matched Audiences, and Facebook Custom Audiences for these purposes. These advertisements may be shown within our Service.

3. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. 

We may disclose personal information that we collect, or you provide to us, as described in this Privacy Policy:

  • To our affiliates;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about the Service users is among the assets transferred;
  • With certain business partners to provide requested services that we do not provide directly, or our other legitimate business purposes;
  • To fulfill the purpose for which you provide it; and
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce or apply our Terms of Use available at https://www.bypg.com/terms; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, our customers, or others.

4. Our Use of Tracking Technologies

We and our service providers operating on our behalf, and other businesses who collect information on our pages may automatically collect or receive certain information associated with you and/or your devices as part of your use of the Service through device-based tracking technologies such as cookies, pixels, tags, beacons, scripts, or other technology. The purpose for the collection and use of this data is that we have a business need to make our website operate efficiently and to provide you with the ability to save your preferences, such as login and preferred language. In addition, we use cookies through the Service to understand visitor and user preferences, improve their experience, and track and analyze usage, navigational and other statistical information.

In some instances, we may participate in behavior-based advertising through the Service, which means that technology (e.g., a cookie) is used to collect information about your use of our Services to provide advertising about products and services tailored to your interests through our Service, or on other websites. The information we collect may include geolocation data, such as (a) information that identifies the precise location of your mobile device (when you agree to allow an app or Service to collect this) and (b) your IP address, which may be used to estimate your approximate location. We use this information to ensure that the Service works properly, and to deliver customized content and advertising, including personalized ads, to you. 

Some browsers have options that allow the visitor to control whether the browser will accept cookies, reject cookies, or notify the visitor each time a cookie is sent. You may elect to reject cookies by adjusting your settings, but doing so may limit the range of features available to you on our Service and other major websites that use cookies. 5. Our Retention of Your Information

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. Our Protection of Your Information

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from the Service is at your own risk. You should only access the Service within a secure environment.

7. Children

Parents should always supervise their children while online. The Service is not designed nor intended to collect personal information from children under the age of thirteen. So that we may comply with the Children’s Online Privacy Protection Act, we ask that children under the age of thirteen not provide any personal information through the Service. If a child under the age of thirteen has provided us with personal information, we ask that a parent or guardian contact us at the email address provided below.

8. Do Not Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do­Not­Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

9. Updates to this Policy

We may revise this Privacy Policy from time to time at our sole discretion. The updated version will be indicated by an updated “Last updated” date below and the updated version will be effective as soon as it is accessible. Your continued use of the Service following a revision of this Privacy Policy is deemed to be acceptance of the changes. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.
